Terms and Conditions of Sale

The present document defines the terms and conditions for use of the online sales service provided via the web services portal located at the following address: http://store.bordeaux.aeroport.fr (hereinafter referred to as “The Website”) by the company described below:
Aéroport de Bordeaux-Mérignac, SA (hereinafter referred to as ADBM SA), a joint stock company with a Board of Directors and Supervisory Board, with a capital of 148,000 euros.
Headquarters: Aéroport de Bordeaux-Mérignac, Cidex 40, 33700, Mérignac  
Registered with the Bordeaux Companies’ Register under the number B 487 607 202.

Article 1 - Purpose

These terms and conditions govern the sale by the Company ADBM SA of access to the Lounge located in Hall A of the airport; the airport’s internal regulations are available at http://bordeaux.aeroport.fr   

Article 2 - Price

The prices for our services are indicated in euros and include all taxes (VAT and other taxes applicable on the order date) unless otherwise indicated, and excluding administrative and shipping fees.
All orders, whatever their origin, are payable in euros.  
The Company ADBM SA reserves the right to change its prices at any time, but the services provided will be invoiced based on the rates in effect at the time of order confirmation, and subject to availability.

Article 3 - Orders

Customers may order online at the address: http://store.bordeaux.aeroport.fr
The terms and conditions of sale are provided in English and French, and their acceptance must be confirmed at the latest upon validation of the customer’s order.  
When ordering, the customer certifies that they are a natural person over the age of 18, acting either on their own account or on behalf of a legal entity that the customer is duly authorized to represent. The customer must agree that they have the full legal capacity to conduct transactions under the present terms and conditions of sale.

At the time of their first order via the website http://store.bordeaux.aeroport.fr, the customer must register by creating a "Customer Account" for which they must enter a username (composed of their email address) and a password containing at least six alphanumeric characters. Before each new order, they must sign in using both these elements, which serve as proof of their identity. They thus agree to provide true and accurate information about themselves during registration.
Login credentials constitute personal and confidential data, which the customer agrees not to disclose. The customer is solely responsible for their use. The data recorded constitutes proof of all transactions made on the site.
Any attempt to substitute a username or password belonging to another customer is strictly prohibited. ADBM SA reserves the right to remove customer accounts with no advance notice or compensation in the case of non-compliance with the present terms and conditions of sale, particularly in the case of fraudulent use.

Article 4 - Order Confirmation

Any order made on the website http://store.bordeaux.aeroport.fr implies acceptance of the present terms and conditions.
The customer may check and modify their shopping cart at any time before confirming their order to express definitive acceptance.
Order confirmation shall be valid as signature and acceptance of the transactions performed, and shall imply the customer’s full and complete acceptance of these terms and conditions of sale, without exception or reservation.  
Summary information concerning the order will be sent to the e-mail address for order confirmation provided by the customer in their account. It is recommended that this confirmation email be saved or printed, along with the payment certificate. All data provided and the confirmation recorded shall constitute proof of the transaction and the customer acknowledges their perfect awareness of the same.
The company ADBM SA reserves the right to refuse payment and reject any order for any reason, particularly in the case of supply and/or availability issues regarding the service, or in the case of any other difficulty concerning the order received.
New orders shall only be accepted after the full and timely settlement of the amounts due for previous orders.

Article 5 - Booking a space in the Hall A Lounge

Booking may be made no more than 30 days before the expected date of arrival at the Lounge. Reservations may be made up to the last minute on day D of the desired reservation date and time.
It is not possible to modify a reservation once it has been confirmed and paid.

Proof of purchase is to be presented upon entry to the Lounge and may be presented in various forms:
- confirmation received via an email address: the beneficiary agrees to present proof upon entry to the Lounge in order to be granted access.
- as access to the lounge is name-based, authorized persons may also present proof of identity or their boarding pass. As long as they have correctly entered their first and last name when making the reservation they will be recognized as holding valid authorization access once the hostess has verified the customer's presence in the reservation listings.

If none of the above are presented, access to the Lounge may be refused.

Article 6 - Payment

Confirmation of an order incurs the customer’s obligation to pay the price indicated. Purchases shall be paid by bank card using a secure payment system. Only cards in the Carte Bleue, Visa, Eurocard/Mastercard networks will be accepted, and the customer explicitly acknowledges that they are authorized to use the card.
The customer may not withhold any amounts due, under any circumstances, in whole or in part, even on grounds of a submitted claim, or deduct any compensation. All orders shall be paid and debited upon acceptance.
If for whatever reason the payment is invalid, incomplete or non-existent, the sale of the service cannot be carried out.
No modification of orders is possible once payment for the same has been made.

Article 7 - Withdrawal

Under the provisions of article L.221-18 of the French Consumer Code, the customer shall have a 14-day cancellation period, counted from the day following the confirmation of their order, to exercise their right of cancellation without having to provide justification or pay any penalty.  
In order to exercise their right of cancellation, the customer may use the standard cancellation form, or any other document, which they may send by email to daf_facturation@bordeaux.aeroport.fr, or by post to AEROPORT DE BORDEAUX, Service comptabilité clients, Cidex 40, 33700 MERIGNAC, as long as their request unambiguously indicates the customer's intent to cancel.
In all cases, the cancellation document must at minimum contain the customer’s first and last name and reservation number.
Following the cancellation, the amount of the order will be refunded in full within fourteen days of the date of ADBM SA’s receipt of notice of the cancellation request. ADBM SA will refund the amounts in question using the same payment method used for the initial transaction, unless the customer expressly agrees to a different method; in any event, this reimbursement will not incur any cost to the customer.
If the provision of services has been executed in full prior to the exercise of the right of cancellation, no refund will be provided.

EXCEPTIONS TO THE RIGHT OF CANCELLATION  
Under the provisions of article L.221-28 of the French Consumer Code, the right of cancellation shall not apply to:  
•    The provision of services executed in full before the end of the cancellation period, the execution of which began after the consumer’s express prior consent and express waiver of the right of cancellation.
•    The provision of goods or services whose price depends on fluctuations in the financial market beyond the provider’s control that may occur during the cancellation period.
•    The provision of hosting services other than residential hosting, merchandise transportation services, car rental services, catering, or recreational activity services that must be provided on a specific date or within a specific period of time.

Article 8 - Availability

Our products and services are on offer as long as they remain visible on the website http://store.bordeaux.aeroport.fr  

Article 9 - Liability

The services offered comply with French legislation in force. ADBM SA may not be held liable in cases where non-fulfilment of its obligations is due to a case of force majeure as defined by French law, or when the damages have resulted from an improper use of the service ordered.
ADBM SA may not be held liable in cases where inconvenience or damages have arisen due to problems inherent to use of the Internet network such as service disruptions, outside intrusion or computer viruses.

Article 10 - Applicable law in case of disputes

The language of the present contract is French. The present terms and conditions of sale are subject to French law. Disputes may only be heard by courts within the jurisdiction of the Court of Appeals of Bordeaux.

Article 11 - Intellectual Property

All elements of the site http://store.bordeaux.aeroport.fr are and remain the exclusive intellectual property of ADBM SA and of their respective owners. The reproduction, exploitation, reposting, or use for any purpose whatsoever of elements of the website, whether software, visual, or audio, even in part, is prohibited. Simple or hypertext linking is strictly prohibited without the express written consent of ADBM SA.

Article 12 - Personal data

The Company ADBM SA reserves the right to collect personal information and personal data concerning its customers. This is necessary for order management and for improving the services and information that the Company ADBM SA provides to its customers.  
This data may be sent to companies that contribute to these relationships, such as those in charge of the execution of services and orders in terms of their management, execution, processing and payment.  
This information and data is also retained for security purposes, in order to meet legal and regulatory obligations.  
Depending on the choices made at the time of the creation or modification of their “Customer Accounts,” the customer may receive emails containing information, commercial offers and news from ADBM SA; they may unsubscribe from these at any time via a link contained in the email.

Under the provisions of the French law of 6 January 1978, the customer has the right to access, correct and oppose the use of personal information and personal data concerning them. Article 13 - Cookies

During a visit to the Site, cookies are stored in the user's browser; these cookies allow ADBM SA to analyse their audience, improve user experience and identify problems with the site.

Article 14 - Complaints

Any questions, inquiries or complaints about the site should be addressed to info@bordeaux.aeroport.fr
If, after submitting their complaint to ADBM SA, the customer does not receive a satisfactory response within 60 days, they may refer the matter to the Tourism and Travel Arbitration Board*, whose contact details and referral procedures are available at: www.mtv.travel

* for contractual disputes between a consumer and a provider regarding the execution of a contract for the sale or supply of services.

Article 15 - Recordkeeping / Evidence

The Company ADBM SA will keep records of purchase orders and invoices, on reliable and durable media, constituting true copies in compliance with article 1379 of the French Civil Code. The computerized records of the Company ADBM SA, stored in ADBM SA’s computer systems in reasonable security conditions, shall be considered by all parties as sufficient proof of communications, orders, payments and transactions made between the parties.
If any one of the clauses or provisions of the present terms and conditions of sale is invalidated or declared unlawful by a definitive court decision, such invalidation or illegality will not affect the other clauses and provisions, which shall remain fully applicable.
